Post Gambino mobsters D’Amico and Watts offered plea deals
Reputed Gambino crime family mobster John “Jackie the nose” D’Amico and Gambino family associate Joseph “Joe the German” Watts may have received offers they can’t refuse. It seems both men who were indicted back in February of 2009 for their alleged roles in the murder of Fred Weiss a Staten Island businessman have been offered plea deals. Late Gambino family boss John Gotti believed that Weiss may have been cooperating with the Fed’s wanted him whacked out.

There have already been a gang of wiseguys nailed by the Fed’s for the Weiss murder including members of the New Jersey based DeCavalcante Family. After a missed attempt by members of the Gambino family including D’Amico and Watts the late Gotti turned to the Decavalcante’s to carry out the hit. Weiss who owned a recycling company that was possibly part of an investigation by the Fed’s into the private sanitation industry. Gotti thought that Weiss may cooperate and finger the Gambino family capo James “Jimmy Brown” Failla who controlled the industry throughout New York from his position in the trade waste association.

Sources say that D’Amico the one time Gambino family boss has been offered a very sweet deal in which he would plead guilty to attempted assault and would receive a sentence of less then three years. This plea is a no-brainer for D’Amico says one defense attorney as he faces more then three years on the other charges in his indictment which include extortion and money laundering. Sources say that if D’Amico agrees to the plea offer it would satisfy all the charges against him in the murder and racketeering indictment and he would enjoy a sentencing cap of only three years. If D’Amico goes along with the plea offer he would only spend another 20 months or so behind bars with time already served awaiting trial.

Joe the German has been offered a somewhat less favorable plea offer sources say of ten years in prison. But Watts is still awaiting for Manhattan Federal Judge Colleen McMahon to uphold the validity of the indictment the Fed’s have against him. Watts claims that back in 1996 as part of a plea deal he agreed to from prosecutors in Brooklyn he received an assurance that he would not be prosecuted for the killing of Weiss if he pleaded guilty to another hit ordered by former Gambino boss John Gotti on another possible witness against family capo Failla. Watts claims that now the Fed’s are reneging on there original deal and him now being charged with the Weiss murder 12 years later is not fair and it violates the double jeopardy protection offered by the constitution and the spirit and letter of the previously agreed upon plea deal.

The chief mob prosecutor for the Manhattan U.S. Attorney’s office Miriam Rocah nor lawyers for either D’Amico and Watts would comment on any plea offers or discussions. The trial for both gangsters is set to begin in September.

Feds have nothing on these guys for serious time. They know it. Thats why they are double dipping on old crimes just so they can keep them held without bail for a little while. Keeps them off the street, they try and shake up the family. See who gets bumped up, look for new faces etc.
